Understanding car seat legislation in Portugal: key requirements every parent should know

In Portugal, all children under the age of 12 or shorter than 135 cm (whichever comes first) must use an appropriate car seat. This law is in place to ensure child passenger safety and is strictly enforced. 

This requirement applies to private vehicles and transfer services. However, there are some exceptions where children may be transported without car seats, as long as they are not seated in the front seats:

  • Vehicles intended for public passenger transport.
  • Individual and remunerated passenger transport in vehicles not registered as taxis from an electronic platform (TVDE/ rideshare services).
  • Transport in vehicles dedicated to transporting patients.

Even though it's not required in taxis or rideshares like Uber and Bolt, traveling without a car seat is unsafe. The risks are the same whether you're using a taxi, rideshare service or private car.

Car seat safety standards in Portugal: ECE R44 vs. ECE R129

An appropriate car seat does not mean just any car seat - it must be approved and suited to the child’s weight and/or weight + height according to these safety regulations. 

The two main European car seat standards you’ll encounter in Portugal are ECE R44/04 and ECE R129. Here’s a closer look at each:

  • ECE R44/04: Classifies car seats only by the child’s weight. Valid if owned and still allowed for use until expiration. While being R44-certified does not mean a seat is unsafe, it has been replaced by the newer ECE R129 standard which offers enhanced safety features.

    • Group 0+ category car seats: Newborns up to 13 kg (rear-facing)
    • Group 1 category car seats: 9-18 kg (approximately 12 months to 4 years old, rear or forward-facing)
    • Group 2 category car seats: 15-25 kg (approximately 4-7 years old, forward-facing)
    • Group 3 category car seats: 22-36 kg (approximately 7-12 years old, forward-facing)
    • Booster seats (Group 2/3) are being phased out in favor of car seats that offer better side-impact protection.
  • ECE R129: Classifies car seats by the child’s height and weight, ensuring improved side-impact protection and requiring rear-facing seats until at least 15 months.

Understanding the differences between R44 and R129 is important because each standard has its own rules and recommended installation modes, helping families choose the safest option for their child.

We recommend keeping your child in a rear-facing car seat until they reach the height or weight limit set by the manufacturer, as it offers the best safety in a collision.

We do not recommend backless booster seats due to the lack of back or side protection, making them unsafe in side collisions. However, they may be used if a child’s size prevents fitting in a seat with proper protection or when transporting three children in the back seat.

Proper installation: a crucial safety step

Proper car seat installation is essential to ensure your child’s safety. Follow these key tips to guarantee an effective installation:

Harness adjustments

1. Shoulder straps

  • Rear-facing: The harness should sit at shoulder level or slightly below.
  • Forward-facing: The harness should sit at shoulder level or slightly above.

2. Harness tightness

  • Use your thumb and index finger to pinch the harness. If you can pinch extra webbing, it needs tightening.
  • The harness should be snug and lie flat against the child’s body. As a general rule, you should only be able to fit one finger between the harness and the child’s shoulder or chest.

3. No twists:

  • Ensure the harness straps are flat with no twists. Twists can cause the straps to function less effectively in the event of a crash, potentially leading to injury.

Headrest position

  • The headrest should be about an inch above your child’s head.
  • If needed, adjust or remove the vehicle’s headrest to ensure proper car seat installation.

ISOFIX / seat belt Installation

  • Ensure the ISOFIX indicators confirm a secure connection.
  • The car seat should be installed squarely on the vehicle seat.
  • Always make sure to remove any slack from the seatbelt securing the car seat, ensuring it is tightly fastened to the vehicle.

Additional information

  • Install the car seat according to the manufacturer's instructions.
  • Children don't need to wear too many clothes, as the car seat itself can get warm. Dressing them lightly will help keep them comfortable during the ride.
  • Best car seat positions in a vehicle:
    1. Rear middle seat - Safest as it's farthest from impact points.
    2. Rear passenger side - Next best, allowing easy access away from traffic.
    3. Rear driver’s side - Also a safe and practical alternative.
    4. Front passenger seat - Avoid unless necessary and only if the airbag is disabled.
